"The Pianist" banned
Metin Celal, Secretary General of the Turkish Publishers Association, gave examples of contradiction between the legislative reforms and the practice in real life. He stated that although the film Pianist, which secured an Oscar Award for actor Adrian Brody, was freely shown in Turkish cinemas, the Turkish translation of the book version of the movie was banned on the grounds of obscenity. In a similar controversy, Turkish translation of Marquis de Sade’s book Philosophy in the Bedroom was banned over 200 years after its first appearance.
Freedom of Expression Lawyer Fikret Ilkiz emphasized the positive constitutional amendments and the particular impact of these provisions on freedom of expression. However, he made clear that the changes in law concerning the print press, newspaper, radio and television broadcast were still in sharp conflict with freedom of expression. In particular, the fines imposed on the basis of these laws are far too high, even after the latest legislative modifications. Consequently, newspapers, radio or television stations still face the risk of bankruptcy. He also said that Article 7 of the Anti-Terror Law and Articles 426 and 427 of the Turkish Penal Code were weapons frequently used by the Turkish authorities to limit the exercise of freedom of expression in the country. In the future, the implementation of the new laws will have to be assured at the administrative level if freedom of expression is to progress in every day life.
